{"id":3398,"date":"2022-01-05T09:52:33","date_gmt":"2022-01-05T09:52:33","guid":{"rendered":"https:\/\/jperelloabogados.com\/?p=3398"},"modified":"2022-01-05T09:52:33","modified_gmt":"2022-01-05T09:52:33","slug":"the-legal-guarantees-that-the-owner-can-demand-in-the-rental-contract-of-a-home","status":"publish","type":"post","link":"https:\/\/jperelloabogados.com\/en\/legal\/the-legal-guarantees-that-the-owner-can-demand-in-the-rental-contract-of-a-home\/","title":{"rendered":"The legal guarantees that the owner can demand in the rental contract of a home"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;border-width: 0px 0px 0px 0px;border-color:rgba(0,0,0,0.08);border-style:solid;\" ><div class=\"fusion-builder-row fusion-row fusion-flex-align-items-flex-start\" style=\"max-width:1372.8px;margin-left: calc(-4% \/ 2 );margin-right: calc(-4% \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-flex-column\"><div class=\"fusion-column-wrapper fusion-flex-justify-content-flex-start fusion-content-layout-column\" style=\"background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;padding: 0px 0px 0px 0px;\"><div class=\"fusion-text fusion-text-1\" style=\"text-align:left;\"><p>Dada la situaci\u00f3n que estamos atravesando, conviene recordar algunos de los\u00a0<strong>mecanismos jur\u00eddicos que pueden mitigar o reducir aquello que los propietarios tanto temen<\/strong>\u00a0(y con raz\u00f3n) como es el<strong>\u00a0impago.<\/strong><\/p>\n<p>Si bien hay una gran demanda en el mercado del arrendamiento de vivienda, impulsada en estos \u00faltimos meses debido a la crisis del covid, debemos extremar las precauciones m\u00e1s que nunca, ya que muchos de estos inquilinos vienen (y perm\u00edtanme la expresi\u00f3n) \u201crebotados\u201d de otros inmuebles; en muchas ocasiones porque han sido desahuciados, no pod\u00edan seguir pagando la renta, o no han llegado a un acuerdo de modificaci\u00f3n de las condiciones del contrato. Estas son algunas de las muchas razones que han hecho crecer exponencialmente el tr\u00e1fico arrendaticio estos \u00faltimos meses.<\/p>\n<p>Por ello, es necesario<strong>\u00a0seleccionar bien las personas a las que les confiamos nuestro inmueble<\/strong>\u00a0y asegurar, en la medida que est\u00e9 en nuestras manos, el cumplimiento de las obligaciones dimanantes del contrato de arrendamiento. A continuaci\u00f3n, resumo algunos consejos y mecanismo jur\u00eddicos adicionales (permitidos por el<strong>\u00a0art\u00edculo 36.5 de la\u00a0Ley de Arredamientos Urbanos -LAU-<\/strong><a href=\"https:\/\/www.idealista.com\/news\/etiquetas\/ley-de-arrendamientos-urbanos\">)<\/a>\u00a0con tal objeto:<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"40\" data-lineheight=\"48px\"><strong>Asegurarse de la solvencia del potencial arrendatario<\/strong><\/h2>\n<p>Deviene necesario a este respecto\u00a0<strong>solicitar las n\u00f3minas o declaraciones de la renta<\/strong>\u00a0m\u00e1s recientes para comprobar que se trata de una persona con ingresos peri\u00f3dicos suficientes para hacer frente el alquiler y las rentas acordadas.<\/p>\n<p>Por otro lado, existen otros mecanismos como la comprobaci\u00f3n de los datos del potencial inquilino en los\u00a0<strong>registros morosos\u00a0<\/strong>que existen actualmente, como la\u00a0base de datos de inquilinos morosos de idealista.<\/p>\n<p>Adicionalmente, aquellos inquilinos que no est\u00e9n dispuestos a hacer frente a determinadas garant\u00edas exigidas (tales como un aval, o un fiador solidario) puede que no nos interesen, dado que ya demuestra su poca solvencia o falta de seguridad al suscribir el contrato.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"40\" data-lineheight=\"48px\"><strong>Suscribir un seguro de impago de alquiler<\/strong><\/h2>\n<p>Si queremos quedarnos tranquilos y olvidarnos de los impagos de alquiler, posibles destrozos que puedan causarse en la vivienda\u2026, y\u00a0<strong>no nos importa perder una mensualidad\u00a0<\/strong>de la renta (aproximadamente) entonces es 100% recomendable suscribir un contrato de seguro de impago de alquiler.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"40\" data-lineheight=\"48px\"><strong>Contrato de arrendamiento<\/strong><\/h2>\n<p>Tener un buen\u00a0contrato de alquiler\u00a0es fundamental, en el mismo es muy recomendable<strong>\u00a0incluir cl\u00e1usulas penales en caso de impago de alquiler\u00a0<\/strong>(tales como intereses de demora o carga de gastos extrajudiciales), anexo con fotograf\u00edas de la vivienda para dar fe del estado en que se encuentra en el momento del arrendamiento, un inventario del mobiliario arrendado junto con el inmueble, etc.<\/p>\n<p>Es tambi\u00e9n necesario\u00a0<strong>incluir a todas las partes del contrato en el mismo<\/strong>\u00a0y establecer un r\u00e9gimen de responsabilidad solidaria (por ejemplo, si se trata de una pareja, que suscriban el contrato ambos pues cuantas m\u00e1s personas suscriban el contrato, m\u00e1s personas devienen responsables del mismo). Para ello, conviene redactar con cautela el contrato y acudir a un buen profesional que lo redacte o revise para garantizar que se ajusta a las necesidades de cada caso.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"40\" data-lineheight=\"48px\"><strong>Aval bancario<\/strong><\/h2>\n<p>A parte de la fianza obligatoria, es muy recomendable exigir\u00a0un aval bancario al arrendador,\u00a0si es posible a<strong>\u00a0primer requerimiento y sin beneficio de excusi\u00f3n.<\/strong><\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"40\" data-lineheight=\"48px\"><strong>Dep\u00f3sito<\/strong><\/h2>\n<p>A diferencia de la fianza obligatoria, esta garant\u00eda adicional no es una mensualidad de la renta, sino que es una\u00a0<strong>cuant\u00eda libremente pactada entre las partes<\/strong>\u00a0(sin sobrepasar dos mensualidades de renta). Esta cl\u00e1usula se debe incluir en el contrato con la cantidad exacta que se va a entregar como dep\u00f3sito de garant\u00eda.<\/p>\n<p>Otra diferencia con la fianza es que el dep\u00f3sito no debe entregarse al organismo pertinente en la Comunidad Aut\u00f3noma, sino que<strong>\u00a0lo custodia el propietario.\u00a0<\/strong>Este dep\u00f3sito de garant\u00eda se devuelve al finalizar la relaci\u00f3n inquilino-propietario, siempre y cuando no haya deudas pendientes, no se haya producido una rotura contractual y no haya desperfectos en el piso, provocados por un mal uso del inmueble.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"40\" data-lineheight=\"48px\"><strong>Fiador Solidario<\/strong><\/h2>\n<p>Se trata de una tercera persona ajena al contrato de arrendamiento que, en caso de incumplimiento del mismo, se convierte en\u00a0<strong>responsable solidario<\/strong>.
